Privacy Policy and Terms and Conditions of Use for the Moodle e-Learning Platform "Early Nutrition Specialist (ENS) MasterClass". 

The following terms and conditions apply to all users of the Moodle e-Learning platform “Early Nutrition Specialist (ENS) MasterClass”, hosted by Ludwig-Maximilians Universität (LMU) Munich and the Dr. von Haunerschen Kinderspital at Klinikum LMU, which will be abbreviated as “Learning Platform” hereafter. The terms and conditions apply to all registered users of the Learning Platform and users with visitor/guest access.

1. Purpose – What Is “ENS MasterClass” and What Can It Be Used for?

The ENS MasterClass programme is an e-learning initiative offered by Ludwig-Maximilians Universität in Munich in collaboration with the Child and Family Health Academy (ChiFHA). ENS MasterClass offers specialized and personalized education in the area of early nutrition and lifestyle for international midwives In collaboration with international experts in the field, we provide the latest scientific evidence and international recommendations for the busy healthcare professionals to easily incorporate them in their day-to-day patient evaluation and counseling.

The ENS MasterClass programme goes far beyond developing standard skills and competencies for nutritional and lifestyle counseling: it will bring to the healthcare professional the latest research findings directly transferrable into clinical decision-making by consolidating the most current evidence base deriving from our leading position in early nutrition and lifestyle research coordination. In joint development with experts in learning sciences, we capitalize on the most effective and efficient didactical and pedagogical concepts in e-learning.

The programme is comprised of 4 courses delivering fundamental latest scientific evidence-based knowledge on nutrition in early life spans, each with a learning time of 45 min, plus 15 minutes for the knowledge and confidence assessments (per month). 

Additional further reading and references ensure that in-depth interests can be met on demand. Self-comprised key essentials and infographics of all courses are just two examples of added-value and sustainable e-learning experiences. The user will be assisted in the conduction of the programme in the form of automatic reminder messages per email and by tracking individual progress. Upon successfully completing the programme requirements, the user receives a Certificate of Completion, issued by the LMU Munich and its programme partners. Note: the LMU Certificate of Completion “Early Nutrition Specialist (ENS) MasterClass” is not an academic degree and does not entitle the user to claim for any kind of ECTS or academic qualification.

2. Data Protection

Personal data related to you will be processed when you use the Learning Platform. The data are associated with you personally. It is our duty to inform you that these data will be collected and processed and what your rights are with regard to the collection and processing of data. We ensure that only internal persons receive access to this information if they absolutely need it. Personal data are treated confidentially by us and not made available to the general public.

The basis for processing personal data is in particular the EU General Data Protection Regulation (GDPR) and the Bavarian Data Protection Act (Bayerische Datenschutzgesetz). The collected data will be processed for the purpose described in Section 1. The information provided, such as progress in the course, completion, e-mail address, name, and other aggregated data, is shared with program partners and processed exclusively for the purpose described under Section 1 and for the continuous technical improvement of the system operation by the operator of the Learning Platform (see Section 5). The intention is not to use the data for purposes other than those mentioned above. If the data are to be used for other purposes in the future, e.g., for scientific research purposes, we will inform you in advance.

There is no profiling in the sense of the EU General Data Protection Regulation. Tests are evaluated automatically. The test questions for each individual course are professionally compiled by people. In the following, we will describe the personal data processed. Other personal data may only be collected and processed on the Learning Platform in accordance with the legal requirements if there is an appropriate legal basis.

2.1. Registration on the Learning Platform

Use of this system is only permitted for users over the age of 16. If you are under the age of 16 and the use of the Learning Platform is mandatory for you, please contact the system operator as described in Section 5.

2.2 What Data Are Stored?

Most of the data are entered by you. These data are so-called “inventory data”, which you actively enter, for example, in forums. Therefore, you already know these data. Other inventory data are automatically generated by evaluations during tests and tasks. Master data consist of information such as your name and e-mail address (as described in Section 2.1). Engagement data include the courses that you use and what you have done in these courses and when (e.g. which pages you have accessed) or, for example, your performance results in the courses (test results, etc.).

Most data are stored in the database of the Learning Platform. This is located on servers of Hetzer Online GmbH, Gunzenhausen, which are administered and maintained by Soon-Systems GmbH, Ulm. Soon-Systems GmbH also generates log files on your usage. The following data are stored by Soon-System GmbH: IP address of the accessing end device; date and time of access; requested resource; status code of the responding web server; size of the transferred data; website from which the delivered resource was requested (“referrer”); browser type identification; error message issued by the web server in case of an error.

The engagement data stored by Soon-Systems GmbH are recorded exclusively for administrative or statistical purposes. The data transfers required for this are secured.

2.3. Cookies

Cookies (short text information) are used by the Learning Platform in several ways:

Session cookie: This cookie is necessary so that the Learning Platform can identify you when you access multiple pages without requiring you to authenticate yourself each time you switch pages. The cookie is stored the first time you access the Learning Platform and remains until you log off the Learning Platform or close your browser (the latter can be prevented by local browser settings, if necessary).

Usability cookies: Individual components of the Learning Platform use cookies to increase user-friendliness – for example, to save the status of visible or hidden website elements when multiple pages are accessed.

The other cookie is for convenience and is called MoodleID by default. This cookie stores the login name in the web browser and remains there even after you log out. When you log in the next time, your login name is already entered. You can prevent this cookie from being set, but then you will have to enter your login name each time you log in.

2.4. Who Has Access to What?

The program consists of “Courses” that are divided into “Lessons”. Participants are assigned to specific cohorts, which gives them specific access rights to the courses and units.

Country-specific contact persons at our program partners can view the data on the Learning Platform of the participants assigned to them. These partners solely send you the invitation and a registration code for the Learning Platform, so you have given your direct consent to the data collection by the program partner on site.
Courses are generally “closed,” i.e., they are only accessible to a group of persons defined by the course director or manager.

Course directors and managers are generally employees of LMU or of the Child Health Service gGmbH. They have access rights to a course room that they are in charge of. They are able to set content and activities, while also controlling access to the course and the roles and rights within the course. For the management of participants, they can access the list of participants and thus the master data of all course participants. For the activation of participants, they can access the given name, surname, and e-mail address of all users. In addition to this, they have access to all content that users create in the course (e.g., forum entries, submissions, etc.)

Administrators are the persons entrusted with the technical administration of the Learning Platform and with access rights to the entire system. They can access all data of the Learning Platform as well as the engagement data collected by Soon-Systems GmbH. These rights are only granted to a few employees assigned to system support.

Administrators of Soon-Systems GmbH can (from a technical point of view) have unlimited access to the Learning Platform. However, their service tasks only include access to log data for technical administration purposes.

2.5. Transmission and Recipient

We may share some of your data (as described in Section 2.1) with our program partners, solely for the purpose described in Section 1.

The program partners, the Nestle Nutrition Institute (NNI) and the Wyeth Nutrition Science Center (WNSC), are sent some of the user data (name, e-mail address, performance results in the courses) as part of the collaboration agreement with Société des Prodults Nestlé S.A.

Most data are stored in the database of the Learning Platform. This is located, which are located on servers of Hetzer Online GmbH, Gunzenhausen, which are administered and maintained by Soon-Systems GmbH, Ulm. Soon-Systems GmbH also generates log files on your usage. Data processing is handled at Soon-Systems GmbH and there is a contract data processing agreement between LMU and Soon-Systems GmbH.

2.5.1. Support and Inquiries

In many cases, our employees are your first point of contact. Please use our support e-mail address: ENS@med.uni-muenchen.de. If you contact us directly, your e-mail address will only be used for correspondence with you. When you receive an e-mail, it is assumed that you also wish to receive a reply by e-mail, unless you express the desire to communicate in another form. If necessary, your e-mail will be forwarded to the responsible department (e.g. course director, computer operation groups, employees of central university administration, deans office, external service providers) for further processing.

2.5.2. Programme Progress

In order to check your progress, your country-specific contact person (see Section 2.4) can view your data.

2.6. Erasure

The personal data are erased from the system as soon as they are no longer required for the purpose of collection.

The data in your user profile are stored until the user profile is erased. User profiles are erased two years after the last login or at the time of withdrawal.

The data from participation in the course will be stored until the course is erased. Results from tests, learning packages, and tasks as well as data on the completion of the course and the overall assessment are stored at most until the expiration of statutory retention obligations.

An erasure check takes place regularly and at least once a year.

2.7. Your Rights

If the legal requirements are met, you have various rights with regard to the controller in terms of the data stored on you. Your rights include:

Information (Art. 15 GDPR): You have the right to receive information on the data stored on you from the controller (see Section 5).

Right to rectification (Art. 16 GDPR): If incorrect data are stored, you can rectify them in part yourself (profile data you entered) or ask the controller to do so. The controller will comply with the request if the rectification is justified and appropriate (Art. 16 GDPR).

Right to erasure (Art. 17 GDPR): You have a right to have data erased if such data are actually incorrect or if the controller has no further purpose for them. There is no right to erase data if the controller is obligated to store the data for statutory reasons or due to other obligations (proof of instruction, proof of quality assurance, copyright usage rights, or an audit right). The obligation to retain data may also apply after the end of participation in the course / the employment relationship. There is also no right to erasure if information has been entered by yourself and such information appears in a context with the information provided by other users (e.g., forum posts).

Right to restriction of processing (Art. 18 GDPR): The controller will ensure that data, if restricted, are only accessible to those persons who absolutely must view the data. For this purpose, they may use pseudonymization and anonymization.

Right to object (Art. 21 GDPR): You can object to the further use of the data. This can only be effective in the future. The right to object is not an automatic obligation for the controller to erase the data. If the controller has storage obligations for other reasons, he or she will weigh these against the request and inform you.

Data portability (Art. 20 GDPR): You have a right to receive data entered by yourself in an electronic format that can be used elsewhere. The right is limited to data processed on the basis of consent or a contract and not subject to a trade secret or other obligations to preserve confidentiality, and therefore may not be transferred to other bodies, or where the data relate to the rights of others, e.g., copyright.

Right of withdrawal (Art. 7 GDPR): You have the right to withdraw your consent to the processing of your data at any time. The withdrawal can lead to the fact that you will no longer be able to access the Learning Platform or participate in a course. Withdrawal does not affect the lawfulness of data processing up to the time of withdrawal.

In the event of a breach of statutory provisions for the protection of the data stored on you, you can contact a data protection supervisory authority (Art. 77 GDPR). The supervisory authority responsible for LMU can be found under Section 5. Please start by contacting the controller or the official data protection officer (see Section 5). In most cases, it is possible to clarify questions and resolve complaints in this way.
In the event of erasure, restriction, or withdrawal, further use of the Learning Platform and access to the learning content stored there as well as participation in the activities and functions available there are no longer guaranteed with immediate effect.

3. Responsibilities of the User/ General usage responsibilities
By registering, the user is granted a non-transferable, simple right to use the Learning Platform.

All uses of the Learning Platform other than those described under Section 1 – in particular private and/or commercial uses – and use for marketing purposes are explicitly prohibited. All users of the Learning Platform are prohibited from storing, processing, changing, suppressing, or erasing personal data without authorization. Storage space made available to the user may only be used to store the created content. Any use other than for the intended purpose is also prohibited.

In addition, users are obligated to comply with statutory provisions in general and with copyright and data protection law in particular. When linking to external websites, the user must check that they do not contain any unlawful content.

Users are not allowed to place any content on the Learning Platform if it violates legal regulations or involves pornographic, obscene, defamatory, slanderous, insulting, threatening, inciting, or racist content. The placing of content for the purpose of advertising of any kind, as well as the transmission of information that contains a virus, error, manipulation, or similar damaging elements, is also prohibited, as is the placing of content that damages the reputation of LMU Munich or the clinic of LMU Munich.

3.1. Special Obligations in Handling Personal Data

In the courses, you may have access in part to personal data, e.g., the names and e-mail addresses or forum entries of other course participants. All users are obligated to treat the data of other users available to them, as well as personal data to which they have access, in a strictly confidential manner and may not pass them on to third parties or process them for other purposes without authorization. The only exception is the appropriate written consent of the data subject.

Special categories of personal data (e.g. patient data/health data) may only be placed in the system for a specific purpose in accordance with the provisions of the GDPR and other legal requirements with the explicit written and effective consent of the data subject. In principle, such data are only to be processed in a pseudonymized, but wherever possible anonymized form.

3.2. Copyright Law

The content, work, and information provided on this website/Learning Platform are subject to German copyright and ancillary copyright law. Any kind of duplication, editing, distribution, storage, and any kind of use outside the limits of copyright law requires the prior written consent of the respective copyright holder. Unauthorized copying/storage of the information provided on this web page/Learning Platform is not permitted and will be subject to prosecution.

The operators of these pages make an effort to respect the copyrights of others or to rely on their own or license-free work.

All brands, logos, trademarks, and product names depicted on internet pages are subject to the property rights of the operators and may not be used without permission. The presentation of these brands on the website does not grant any rights of use and does not imply that these brands and logos are not protected by third-party rights.

4. Other Provisions

4.1. Liability on the part of Users

If a user culpably violates the Terms of Use or legal obligations, he/she is liable as stipulated by law.

4.2. Exclusion of Use

If there is a violation of the Terms of Use, the user will be asked to refrain from such behaviour. If he or she does not comply with this request, the administrators of the Learning Platform will exclude him or her from using the platform. There is no right to re-admission. One of the conditions for re-admission is a written request with an assurance that the abusive behaviour will be refrained from in the future.

4.3. Liability on the part of LMU Munich/Klinikum LMU

LMU Munich/Klinikum LMU, as operator of the Learning Platform, is solely liable for grossly negligent or intentional breaches of duty. This applies in particular to damage caused by downloading software or materials from users. LMU Munich/Klinikum LMU is to be indemnified from claims of third parties due to the non-observance of copyrights by the users of the Learning Platform.

4.4. Amendment of the Terms of Use

LMU Munich/Klinikum LMU reserves the right to extend or amend these Terms of Use.

Users of the Learning Platform are continuously informed about changes to the Terms of Use. The respectively valid Terms of Use are published on the Learning Platform.

4.5. Legal Validity

These explanatory remarks are to be regarded as part of the website that is used to refer to this page. If parts or individual formulations of this text are not consistent with applicable law, or no longer or not completely consistent therewith, such shall not affect the content or validity of the other parts of the document.

8. Use of Webpage Analysis Tool Matomo (formerly PIWIK)

Programs for evaluation of user behaviour on the LMU/Klinikum LMU internet pages are only used by the LMU/Klinikum LMU in an anonymized form. On several internet and Moodle pages we use the Open-Source-Software-Tool Matomo (formerly PIWIK) for analysis of your surfing behaviour. This software places a cookie on your computer. If individual pages - even sub-pages - of our internet pages are called, then the following anonymized data is saved:

• Two bytes of the IP address of the calling system (user’s system)
• The called internet page
• The internet page from which the user has arrived at the called internet page (referrer)

The software Matomo is set up so that full IP addresses are not saved, but rather two bytes of the IP address are masked. In this way an unambiguous association with the calling computer is not possible. Therefore, your IP address is also always anonymized before any evaluation.

The use of Matomo can be disabled in general by making a corresponding setting in your internet browser.

1.Propósito – ¿Qué es "ENS MasterClass” y para qué se puede usar? 

El programa ENS es una iniciativa de aprendizaje electrónico ofrecida por la Universidad Ludwig-Maximilians (LMU) en Múnich en colaboración con Child and Family Health Academy (ChiFHA). ENS ofrece educación especializada y personalizada en el área de nutrición temprana y estilo de vida para parteras internacionales. En colaboración con expertos internacionales en el campo, proporcionamos las últimas evidencias científicas y recomendaciones internacionales para el Personal sanitario ocupado pueda incorporarlas fácilmente en su evaluación y asesoramiento diario de pacientes. 

El programa ENS va mucho más allá de desarrollar habilidades y competencias estándar para el asesoramiento nutricional y de estilo de vida: aportará al personal sanitario los hallazgos de investigación más recientes directamente transferibles a la toma de decisiones clínicas mediante la consolidación de la base de evidencia más actual procedente de nuestra posición de liderazgo en coordinación de investigación de nutrición temprana y estilo de vida. En desarrollo conjunto con expertos en ciencias del aprendizaje, capitalizamos los conceptos didácticos y pedagógicos más efectivos y eficientes en aprendizaje electrónico. 

El programa consta de 4 cursos que proporcionan conocimientos fundamentales basados en la evidencia científica más reciente sobre nutrición en las primeras etapas de la vida, cada uno con un tiempo de aprendizaje de 45 minutos, más 15 minutos para las evaluaciones de conocimiento y confianza (por mes). 

Las lecturas adicionales y referencias aseguran que los intereses más profundos puedan satisfacerse bajo demanda. Los elementos esenciales auto-compilados y las infografías de todos los cursos son solo dos ejemplos de valor agregado y experiencias de aprendizaje electróico sostenibles. Al completar con éxito los requisitos del programa, el usuario recibe un Certificado de Finalización, emitido por la LMU de Múnich y sus socios del programa. Nota: el Certificado de Finalización de LMU “Early Nutrition Specialist (ENS)” no es un título académico y no otorga al usuario derecho a reclamar ningún tipo de ECTS o cualificación académica.

2. Protección de Datos 

Los datos personales relacionados con usted serán procesados cuando utilice la Plataforma de Aprendizaje. Los datos están asociados directamente con usted. Es nuestro deber informarle que estos datos serán recopilados y procesados, y cuáles son sus derechos con respecto a la recopilación y el procesamiento de datos. Nos aseguramos de que solo las personas internas reciban acceso a esta información si es absolutamente necesario. Los datos personales son tratados confidencialmente por nosotros y no se ponen a disposición del público en general. 

La base para el procesamiento de datos personales es, en particular, el Reglamento General de Protección de Datos de la UE (RGPD)y la Ley de Protección de Datos de Baviera (Bayerische Datenschutzgesetz). 2.2 ¿Qué datos se almacenan? 

La mayoría de los datos son ingresados por usted. Estos datos se denominan "datos de inventario", los cuales usted introduce activamente, por ejemplo, en foros. Por lo tanto, ya conoce estos datos. Otros datos de inventario se generan automáticamente mediante evaluaciones durante pruebas y tareas. Los datos maestros consisten en información como su nombre y dirección de correo electrónico (como se describe en la Sección 2.1). Los datos de participación incluyen los cursos que utiliza y lo que ha hecho en estos cursos y cuándo (por ejemplo, a qué páginas ha accedido) o, por ejemplo, sus resultados de desempeño en los cursos (resultados de pruebas, etc.). 

La mayoría de los datos se almacenan en la base de datos de la Plataforma de Aprendizaje. Esta se encuentra en servidores de Hetzner Online GmbH, Gunzenhausen, que son administrados y mantenidos por Soon-Systems GmbH, Ulm. Soon-Systems GmbH también genera archivos de registro sobre su uso. Los siguientes datos son almacenados por Soon-Systems GmbH: dirección IP del dispositivo por el que accede; fecha y hora de acceso; recurso solicitado; código de estado del servidor web que responde; tamaño de los datos transferidos; sitio web desde el cual se solicitó el recurso entregado ("referrer"); identificación del tipo de navegador; mensaje de error emitido por el servidor web en caso de error.

Los datos de participación almacenados por Soon-Systems GmbH se registran exclusivamente para fines administrativos o estadísticos. Las transferencias de datos requeridas para este fin están protegidas

2.3 Cookies 

Las cookies (información de texto breve) son utilizadas por la Plataforma de Aprendizaje de varias maneras: 

Cookie de sesión: Esta cookie es necesaria para que la Plataforma de Aprendizaje pueda identificarle cuando acceda a múltiples páginas sin requerir que se autentique cada vez que cambia de página. La cookie se almacena la primera vez que accede a la Plataforma de Aprendizaje y permanece hasta que cierre sesión en la Plataforma de Aprendizaje o cierre su navegador (lo cual puede prevenirse mediante la configuración local del navegador, si es necesario). 

Cookies de usabilidad: Componentes individuales de la Plataforma de Aprendizaje usan cookies para aumentar la facilidad de uso, por ejemplo, para guardar el estado de elementos visibles u ocultos del sitio web cuando se accede a múltiples páginas. 

Otra cookie: Esta es para comodidad y se llama MoodleID por defecto. Esta cookie almacena el nombre de inicio de sesión en el navegador web y permanece allí incluso después de cerrar sesión. Cuando inicie sesión la próxima vez, su nombre de inicio de sesión ya estará ingresado. Puede evitar que esta cookie se establezca, pero entonces tendrá que ingresar su nombre de inicio de sesión cada vez que inicie sesión.

2.4 ¿Quién tiene acceso a qué? 

El programa consiste de "Cursos" que se dividen en "Lecciones". Los participantes se asignan a cohortes específicas, lo que les otorga derechos de acceso específicos a los cursos y unidades. 

Los contactos específicos de cada país en nuestros socios del programa pueden ver los datos en la Plataforma de Aprendizaje de los participantes que se les han asignado. Estos socios solo le envían la invitación y un código de registro para la Plataforma de Aprendizaje, por lo que usted ha dado su consentimiento directo para la recopilación de datos por parte del socio del programa in situ. 

Los cursos son generalmente "cerrados", es decir, solo son accesibles a un grupo de personas definido por el director o gerente del curso. 

Los directores y gerentes de los cursos son generalmente empleados de LMU o del Servicio de Salud Infantil. Tienen derechos de acceso al aula del curso de la que están a cargo. Pueden establecer contenido y actividades, así como controlar el acceso al curso y los roles y derechos dentro del curso. Para la gestión de participantes, pueden acceder a la lista de participantes y, por lo tanto, a los datos maestros de todos los participantes del curso. Para la activación de participantes, pueden acceder al nombre, apellido y dirección de correo electrónico de todos los usuarios. Además, tienen acceso a todo el contenido que los usuarios crean en el curso (por ejemplo, entradas en foros, entregas, etc.) 

Los administradores son las personas encargadas de la administración técnica de la Plataforma de Aprendizaje y con derechos de acceso a todo el sistema. Pueden acceder a todos los datos de la Plataforma de Aprendizaje, así como a los datos de participación recopilados por Soon-Systems GmbH. Estos derechos solo se otorgan a pocos empleados asignados al soporte del sistema. 

Los administradores de Soon-Systems GmbH pueden (desde un punto de vista técnico) tener acceso ilimitado a la Plataforma de Aprendizaje. Sin embargo, sus tareas de servicio solo incluyen el acceso a los datos de registro para fines de administración técnica.

2.5 Transmisión y Destinatario

Podemos compartir algunos de tus datos (como se describe en la Sección 2.1) con nuestros socios del programa, únicamente para el propósito descrito en la Sección 1.

A los socios del programa, Nestle Nutrition Institute (NNI) y Wyeth Nutrition Science Center (WNSC), se les envían algunos de los datos de usuario (nombre, dirección de correo electrónico, resultados de desempeño en los cursos) como parte del acuerdo de colaboración con Société des Produits Nestlé S.A.

La mayoría de los datos se almacenan en la base de datos de la Plataforma de Aprendizaje. Esta se encuentra en servidores de Hetzner Online GmbH, Gunzenhausen, que son administrados y mantenidos por Soon-Systems GmbH, Ulm. Soon-Systems GmbH también genera archivos de registro sobre su uso. El procesamiento de datos se maneja en Soon-Systems GmbH y existe un contrato de procesamiento de datos entre LMU y Soon-Systems GmbH

2.5.1 Soporte y Consultas

En muchos casos, nuestros empleados son su primer punto de contacto. Por favor, utilice nuestra dirección de correo electrónico de soporte: ENS@med.uni-muenchen.de. Si nos contacta directamente, su dirección de correo electrónico solo se utilizará para la mantener correspondencia con usted. Cuando reciba un correo electrónico, se asume que también desea recibir una respuesta por el mismo medio, a menos que exprese el deseo de comunicarse de otra forma. Si es necesario, su correo electrónico será reenviado al departamento responsable (por ejemplo, director del curso, grupos de operaciones informáticas, empleados de la administración central de la universidad, oficina del decano, proveedores de servicios externos) para su posterior procesamiento.

2.5.2 Progreso del Programa

Para verificar su progreso, la persona de contacto específica de su país (ver Sección 2.4) puede ver sus datos.

2.6 Eliminación

Los datos personales se eliminan del sistema en cuanto ya no se requieran para el propósito de su recopilación.

Los datos en su perfil de usuario se almacenan hasta que el perfil de usuario sea eliminado. Los perfiles de usuario se eliminan dos años después del último inicio de sesión o en el momento de la baja.

Los datos de participación en el curso se almacenarán hasta que el curso sea eliminado. Los resultados de las pruebas, los paquetes de aprendizaje y las tareas, así como los datos sobre la finalización del curso y la evaluación general, se almacenan como máximo hasta la expiración de las obligaciones legales de conservación.

Se realiza una verificación de eliminación de datos de manera regular y al menos una vez al año.

2.7 Sus Derechos

Si se cumplen los requisitos legales, tienes varios derechos con respecto al controlador en términos de los datos almacenados sobre ti. Sus derechos incluyen:

Derecho de acceso (Art. 15 GDPR): Tiene derecho a recibir información sobre los datos almacenados sobre usted por parte del controlador (ver Sección 5).

Derecho de rectificación (Art. 16 GDPR): Si se almacenan datos incorrectos, puede rectificarlos en parte usted mismo (datos del perfil que ingresó) o pedir al controlador que lo haga. El controlador cumplirá la solicitud si la rectificación es justificada y adecuada (Art. 16 GDPR).

Derecho de eliminación (Art. 17 GDPR): Tiene derecho a que se borren los datos si estos son incorrectos o si el controlador ya no tiene un propósito para ellos. No existe el derecho a borrar datos si el controlador está obligado a almacenar los datos por razones legales o debido a otras obligaciones (prueba de instrucción, prueba de aseguramiento de calidad, derechos de uso de copyright, o derecho de auditoría). La obligación de retener datos también puede aplicarse después del final de la participación en el curso o la relación laboral. Tampoco hay derecho de eliminación si la información ha sido ingresada por usted mismo y dicha información aparece en un contexto con la información proporcionada por otros usuarios (por ejemplo, publicaciones en foros).

Derecho a la limitación del procesamiento (Art. 18 GDPR): El controlador se asegurará de que los datos, si están restringidos, solo sean accesibles para aquellas personas que absolutamente deban ver los datos. Para este propósito, se puedrá usar seudonimización y anonimización.

Derecho de oposición (Art. 21 GDPR): Puede oponerse al uso futuro de los datos. Esto solo puede ser efectivo en el futuro. El derecho de oposición no es una obligación automática para el controlador de borrar los datos. Si el controlador tiene obligaciones de almacenamiento por otras razones, las evaluará frente a la solicitud y le informará.

Portabilidad de los datos (Art. 20 GDPR): Tiene derecho a recibir los datos ingresados por usted en un formato electrónico que pueda ser utilizado en cualquier otro lugar. El derecho está limitado a datos procesados sobre la base del consentimiento o de un contrato y no sujetos a secreto comercial u otras obligaciones de confidencialidad, y por lo tanto, no pueden ser transferidos a otros organismos, o cuando los datos se relacionen con los derechos de terceros, por ejemplo, derechos de autor.

Derecho de retiro (Art. 7 GDPR): Tiene derecho a retirar su consentimiento para el procesamiento de sus datos en cualquier momento. El retiro puede llevar a que ya no pueda acceder a la Plataforma de Aprendizaje o participar en un curso. El retiro no afecta la legalidad del procesamiento de datos hasta el momento del retiro.

En caso de infracción de las disposiciones legales para la protección de los datos almacenados sobre usted, puede contactar con una autoridad de supervisión de protección de datos (Art. 77 GDPR). La autoridad de supervisión responsable de LMU se puede encontrar en la Sección 5. Por favor, comienza contactando al controlador o al oficial de protección de datos oficial (ver Sección 5). En la mayoría de los casos, es posible aclarar preguntas y resolver quejas de esta manera.

En caso de eliminación, restricción o retiro, el uso posterior de la Plataforma de Aprendizaje y el acceso al contenido de aprendizaje almacenado allí, así como la participación en las actividades y funciones disponibles, ya no están garantizados con efecto inmediato.

3. Responsabilidades del Usuario / Responsabilidades generales de uso 

Al registrarse, se otorga al usuario un derecho simple e intransferible para usar la Plataforma de Aprendizaje. 

Todos los usos de la Plataforma de Aprendizaje distintos a los descritos en la Sección 1 – en particular usos privados y/o comerciales – y el uso con fines de marketing están explícitamente prohibidos. Se prohíbe a todos los usuarios de la Plataforma de Aprendizaje almacenar, procesar, cambiar, suprimir o borrar datos personales sin autorización. El espacio de almacenamiento disponible para el usuario solo puede utilizarse para almacenar el contenido creado. Cualquier uso distinto al propósito previsto también está prohibido. 

Además, los usuarios están obligados a cumplir con las disposiciones legales en general y con las leyes de protección de datos y derechos de autor en particular. Al enlazar a sitios web externos, el usuario debe verificar que no contengan contenido ilegal. 

No se permite a los usuarios colocar ningún contenido en la Plataforma de Aprendizaje si este viola las regulaciones legales o involucra contenido pornográfico, obsceno, difamatorio, calumnioso, insultante, amenazante, incitador o racista. También está prohibido colocar contenido con el propósito de publicidad de cualquier tipo, así como la transmisión de información que contenga un virus, error, manipulación o elementos dañinos similares, al igual que la colocación de contenido que dañe la reputación de LMU Munich o de la clínica de LMU Munich.

3.1 Obligaciones Especiales en el Manejo de Datos Personales 

En los cursos, puede tener acceso a datos personales, por ejemplo, los nombres y direcciones de correo electrónico o las entradas en foros de otros participantes del curso. Todos los usuarios están obligados a tratar los datos de otros usuarios a su disposición, así como los datos personales a los que tengan acceso, de manera estrictamente confidencial y no pueden transmitirlos a terceros ni procesarlos para otros fines sin autorización. La única excepción es el consentimiento adecuado y por escrito del titular de los datos. 

Las categorías especiales de datos personales (por ejemplo, datos de pacientes/datos de salud) solo pueden ser colocadas en el sistema para un propósito específico de acuerdo con las disposiciones del GDPR y otros requisitos legales, con el consentimiento explícito, escrito y efectivo del titular de los datos. En principio, dichos datos solo deben procesarse de forma seudonimizada y, siempre que sea posible, de forma anonimizada.

3.2 Ley de Derechos de Autor 

El contenido, trabajo e información proporcionados en este sitio web/Plataforma de Aprendizaje están sujetos a la ley alemana de derechos de autor y derechos afines. Cualquier tipo de duplicación, edición, distribución, almacenamiento y cualquier tipo de uso fuera de los límites de la ley de derechos de autor requiere el consentimiento previo por escrito del respectivo titular de los derechos de autor. La copia/almacenamiento no autorizado de la información proporcionada en esta página web/Plataforma de Aprendizaje no está permitido y será objeto de enjuiciamiento. 

Los operadores de estas páginas se esfuerzan por respetar los derechos de autor de otros o por depender de su propio trabajo o de obras libres de licencias.

4. Otras Disposiciones 

4.1 Responsabilidad por parte de los Usuarios  

Si un usuario incumple de forma culposa los Términos de Uso u obligaciones legales, será responsable según lo estipulado por la ley. 

4.2 Exclusión de Uso  

Si hay una violación de los Términos de Uso, se le pedirá al usuario que se abstenga de tal comportamiento. Si no se cumple con esta solicitud, los administradores de la Plataforma de Aprendizaje lo excluirán del uso de la plataforma. No hay derecho a readmisión. Una de las condiciones para la readmisión es una solicitud por escrito con la garantía de que se abstendrá de comportamientos abusivos en el futuro. 

4.3 Responsabilidad por parte de LMU Munich/Klinikum LMU  

LMU Munich/Klinikum LMU, como operador de la Plataforma de Aprendizaje, es el único responsable por incumplimientos de deberes gravemente negligentes o intencionales. Esto se aplica en particular a los daños causados por la descarga de software o materiales por parte de los usuarios. ULM Munich/Klinikum ULM debe ser indemnizado por reclamaciones de terceros debido al incumplimiento de los derechos de autor por parte de los usuarios de la Plataforma de Aprendizaje. 

4.4 Modificación de los Términos de Uso  

LMU Munich/Klinikum ULM se reserva el derecho de extender o modificar estos Términos de Uso. Los usuarios de la Plataforma de Aprendizaje son informados continuamente sobre los cambios en los Términos de Uso. Los Términos de Uso vigentes  se publican en la Plataforma de Aprendizaje. 

4.5 Validez Legal  

Estas observaciones explicativas deben considerarse como parte del sitio web que se utiliza para referirse a esta página. Si partes o formulaciones individuales de este texto no son consistentes con la ley aplicable, o dejan de serlo o no lo son completamente, esto no afectará el contenido o la validez de las otras partes del documento.

El software Matomo está configurado para que las direcciones IP completas no se guarden, sino que se enmascaren dos bytes de la dirección IP. De esta manera, no es posible una asociación inequívoca con la computadora que accede. Por lo tanto, su dirección IP también se anonimiza siempre antes de cualquier evaluación.

Nutzungsbedingungen und Datenverarbeitungshinweis für die Verwendung der Moodle Lernplattform »Early Nutrition Specialist (ENS) MasterClass.

Die folgenden Bedingungen und Bestimmungen gelten für alle Nutzer*innen der Moodle e-Lernplattform »Early Nutrition Specialist (ENS) MasterClass« der Ludwig-Maximilians Universität (LMU) München und dem Dr. von Haunerschen Kinderspital am Klinikum der LMU München, im Folgenden abgekürzt durch » Lernplattform«.  Die Bedingungen und Bestimmungen finden Anwendung auf alle registrierten Nutzer*innen der Lernplattform sowie Nutzer*innen von Besucher-/Gastzugängen.

1. Zweck - Was ist »ENS MasterClass« und für was kann es genutzt werden?

Das ENS MasterClass-Programm ist ein e-Learning Plattform, die von der Ludwig-Maximilians Universität (LMU) in München in Zusammenarbeit mit der Child and Family Health Academy (ChiFHA) angeboten wird. ENS MasterClass bietet eine spezialisierte, personalisierte Fortbildung im Bereich der frühen Ernährung und Lebensweise ausschließlich für Health Care Professionals (HCPs). In Zusammenarbeit mit internationalen Experten auf diesem Gebiet stellen wir die neuesten wissenschaftlichen Erkenntnisse und internationalen Empfehlungen zur Verfügung, die von HCPs leicht in ihre tägliche Patientenbetreuung und -beratung integriert werden können.

Das ENS MasterClass-Programm geht weit über die Entwicklung von Standardfähigkeiten und -kompetenzen für die Ernährungsberatung und Beratung zur Lebensführung hinaus: Es werden HCPs die neuesten Forschungsergebnisse vermitteln, die sich direkt in die klinische Entscheidungsfindung übertragen lassen, da diese auf den aktuellsten Erkenntnisse basieren, die sich aus unserer führenden Position bei der Koordinierung der Forschung im Bereich der frühen Ernährung und Lebensweise ergeben. In Zusammenarbeit mit Bildungswissenschaftlern nutzen wir die effektivsten und effizientesten didaktischen und pädagogischen Konzepte für die e-Learnings

Das Programm besteht aus vier Kursen, die die grundlegenden neuesten wissenschaftlichen Erkenntnisse zur Ernährung im frühen Lebensalter vermitteln. Jeder Kurs umfasst jeweils 45 Minuten Lernzeit sowie 15 Minuten für einen Wissenstest (pro Monat).

Zusätzliche weiterführende Literatur und Referenzen stellen sicher, dass das Interesse, Wissen zu vertiefen, bei Bedarf erfüllt werden kann. Selbst zusammengestellte Key Essentials und Infografiken zu allen Kursen sind nur zwei Beispiele für den Mehrwert und die nachhaltige e-Learning-Erfahrung. Unterstützt wird der Nutzer bei der Durchführung des Programms durch automatische Erinnerungsmeldungen per E-Mail und durch die Verfolgung des individuellen Lernfortschritts. Nach erfolgreichem Abschluss des Programms erhält der Nutzer*in ein Zertifikat, das von der LMU München und ihren Programmpartnern ausgestellt wird. Hinweis: Das LMU-Zertifikat "Early Nutrition Specialist" ist kein akademischer Abschluss und berechtigt nicht zum Erwerb von ECTS oder akademischen Qualifikationen.

2. Datenschutz

Durch die Nutzung der Lernplattform werden persönliche Daten über Sie verarbeitet. Die Daten sind mit Ihrer Person verbunden. Es ist unsere Pflicht, Sie darüber zu informieren, dass diese Daten erfasst und verarbeitet werden und welche Rechte Sie hinsichtlich der Datenerfassung und -verarbeitung haben. Wir stellen sicher, dass intern nur die Personen Zugriff auf diese Informationen erhalten, die diesen Zugang unbedingt benötigen. Personenbezogene Daten werden von uns vertraulich behandelt und nicht der breiten Öffentlichkeit zur Verfügung gestellt.

Grundlage für die Verarbeitung personenbezogener Daten sind insbesondere die EU-Datenschutzgrundverordnung sowie das Bayerische Datenschutzgesetz. Die erhobenen Daten werden zu dem unter § 1 beschriebenen Zweck verarbeitet. Die bereitgestellten Informationen, beispielsweise Kursfortschritt, Abschluss, E-Mail-Adresse, Name und zusätzlich aggregierte Daten werden mit den Programmpartnern geteilt und ausschließlich für den unter § 1 beschriebenen Zweck verarbeitet sowie zur fortlaufenden technischen Verbesserung des Systembetriebs durch den/die Betreiber*in der Lernplattform (siehe § 5). Es ist nicht beabsichtigt, die Daten zu anderen als den o.g. Zwecken zu verwenden. Falls die Daten in der Zukunft doch zu anderen Zwecken, z.B. für wissenschaftliche Forschungszwecke, verwendet werden sollen, werden wir Sie vorab informieren.

Es erfolgt kein Profiling im Sinne der EU-Datenschutzgrundverordnung. Tests werden automatisch ausgewertet. Die Testfragen sind für jeden einzelnen Kurs durch Menschen fachlich zusammengestellt. Im Folgenden beschreiben wir Ihnen welche personenbezogenen Daten verarbeitet werden. Andere personenbezogene Daten dürfen auf der Lernplattform nur bei entsprechend vorhandener gesetzlichen Grundlage nach den gesetzlichen Vorgaben erhoben und weiterverarbeitet werden.

2.1. Anmeldung an der Lernplattform

Zum Zeitpunkt der Anmeldung werden folgende Daten erhoben:

2.2. Welche Daten werden gespeichert?

Die meisten Daten werden von Ihnen selbst eingegeben, dies sind sogenannte "Bestandsdaten", die Sie z.B. im Rahmen von Foren aktiv eingeben. Daher kennen Sie diese Daten bereits. Andere Bestandsdaten entstehen durch Bewertungen bei Tests und Aufgaben automatisch. Stammdaten sind Angaben wie bspw. Ihr Name und Ihre E-Mail-Adresse (wie unter § 2.1 beschrieben). Bewegungsdaten umfassen, welche Kurse Sie nutzen und was Sie wann in diesen Kursen getan haben (z.B. welche Seiten Sie aufgerufen haben) oder zum Beispiel Ihre Leistungsergebnisse aus den Kursen (Testergebnisse u.ä).

Die meisten Daten werden in der Datenbank der Lernplattform gespeichert. Diese befindet sich auf Servern der Firma Hetzner Online GmbH, Gunzenhausen, welche von der Firma Soon-System GmbH, Ulm administriert und gewartet werden. Die Soon-System GmbH erstellt zusätzlich Protokolle über Ihre Nutzung. Folgende Daten werden durch die Soon-System GmbH gespeichert: IP-Adresse des zugreifenden Endgeräts, Datum und Uhrzeit des Zugriffs. aufgerufene Ressource, Status-Code des antwortenden Webservers, Größe der übertragenen Daten, Webseite, von der aus die gelieferte Ressource aufgerufen wurde ("Referer"), Browsertyp-Identifikation, im Fehlerfall vom Webserver ausgegebene Fehlermeldung.

Die von Soon-Systems GmbH gespeicherten Bewegungsdaten werden ausschließlich zu administrativen oder statistischen Zwecken erfasst. Die hierfür nötigen Datenübertragungen erfolgen gesichert.

2.3. Cookies

Cookies (kurze Textinformationen) werden durch die Lernplattform auf mehrere Arten genutzt:

Session-Cookie: Dieses Cookie ist notwendig, damit die Lernplattform Sie über mehrere Seitenaufrufe hinweg identifizieren kann, ohne dass Sie sich bei jedem Seitenwechsel neu authentifizieren müssen. Das Cookie wird beim ersten Aufruf der Lernplattform gesetzt und bleibt erhalten, bis Sie sich aus der Lernplattform abmelden bzw. Ihren Browser schließen (Letzteres kann ggf. durch lokale Browser-Einstellungen unterbunden werden).

Usability-Cookies: Einzelne Komponenten der Lernplattform verwenden Cookies, um die Nutzerfreundlichkeit zu erhöhen - etwa um den Zustand ein- bzw. ausgeblendeter Webseiten-Elemente über mehrere Seitenaufrufe hinweg zu speichern.

Das andere Cookie dient der Bequemlichkeit und heißt standardmäßig MoodleID. Dieses Cookie speichert den Anmeldenamen im Webbrowser und bleibt auch nach dem Abmelden erhalten. Beim nächsten Login ist dann Ihr Anmeldename bereits eingetragen. Dieses Cookie können Sie verbieten, müssen dann aber bei jedem Login Ihren Anmeldenamen neu eingeben.

2.4. Wer hat auf was Zugriff?

Das Programm besteht aus Kursen, die wiederum in „Units“ unterteilt sind. Die Teilnehmer*innen werden bestimmten Gruppen zugeordnet, wodurch diese spezifische Zugangsrechte zu den Kursen und Units erhalten.

Länderspezifische Ansprechpartner unserer Programmpartner, über welche Sie die Einladung und einen Registrierungs-Code für die Lernplattform erhalten haben und vor Ort direkt Ihre Einwilligung zur Datenerfassung durch den Programmpartner gegeben haben, können die Daten auf der Lernplattform der Ihnen zugeordneten Teilnehmer*innen einsehen.

Kurse sind im Allgemeinen "geschlossen", d.h. sie sind nur für einen Personenkreis zugänglich, der vom Kursverantwortlichen oder Manager definiert ist.

Kursverantwortliche und Manager*innen sind im Allgemeinen Mitarbeiter der LMU bzw. der Child Health Service gGmbH. Sie haben Zugriffsrechte für einen Kurs, den sie betreuen. Sie haben die Möglichkeit, Inhalte und Aktivitäten einzustellen sowie den Zugriff auf den Kurs und die Rollen und Rechte innerhalb des Kurses zu steuern. Für die Teilnehmer*innenverwaltung können sie auf die Teilnehmer*innenliste und somit die Stammdaten aller Kursteilnehmer*innen, sowie für die Freischaltung der Teilnehmer*innen auf den Vornamen, Nachnamen und E-Mail-Adresse aller Nutzer*innen zugreifen. Außerdem auf alle Inhalte, welche die Nutzer*innen im Kurs erstellen (z.B. Foreneinträge, Abgaben).

Administrator*innen sind die mit der technischen Verwaltung der Lernplattform betrauten Personen mit Zugriffsrechten für das gesamte System. Sie können auf alle Daten der Lernplattform zugreifen sowie auf die von der Soon-Systems GmbH erhobenen Bewegungsdaten. Diese Rechte erhalten nur wenige Mitarbeiter*innen, die mit der Systembetreuung beauftragt sind.

Administrator*innen der Firma Soon-Systems GmbH können (aus technischer Sicht) uneingeschränkt auf die Lernplattform zugreifen. Zu Ihren Arbeitsaufgaben gehört aber nur der Zugriff auf Protokolldaten zum Zweck der technischen Administration.

2.5. Weitergabe und Empfänger

Wir geben Ihre Daten (wie unter § 2.1 beschrieben) teilweise an unsere Programmpartner weiter, ausschließlich zu dem unter § 1 beschriebenen Zweck.

Den Programmpartnern Nestle Nutrition Institute (NNI) und Wyeth Nutrition Science Center (WNSC) werden die Daten (Name, E-Mailadresse, Leistungsergebnisse aus den Kursen) der Nutzer*innen teilweise im Rahmen des Collaboration Agreements mit Soiété des Prodults Nestlé S.A. übermittelt.

Die meisten Daten werden in der Datenbank der Lernplattform gespeichert. Diese befindet sich auf Servern der Firma Hetzner Online GmbH, Gunzenhausen, welche von der Firma Soon-Systems GmbH, Ulm administriert und gewartet werden. Die Firma Soon-Systems GmbH erstellt zusätzlich Protokolle über Ihre Nutzung. Die Datenverarbeitung erfolgt bei der Firma Soon-Systems GmbH, mit der ein Auftragsverarbeitungsvertrag zwischen der LMU und der Firma Soon-Systems GmbH besteht.

2.5.1. Support und Anfragen

In vielen Fällen sind unsere Mitarbeiter*innen Ihre ersten Ansprechpartner*innen. Bitte nutzen Sie unsere Support-E-Mail-Adresse: ens@med.lmu.de. Wenn Sie sich direkt an uns wenden, wird Ihre E-Mail-Adresse nur für die Korrespondenz mit Ihnen verwendet. Bei Erhalt einer E-Mail wird davon ausgegangen, dass auch die Beantwortung mittels E-Mail gewünscht ist, es sei denn, Sie bringen den Wunsch nach einer anderen Form der Kommunikation zum Ausdruck. Ggf. wird Ihre E-Mail zur weiteren Bearbeitung an die zuständige Stelle (z.B. Kursverantwortliche, Rechnerbetriebsgruppen, Mitarbeiter*innen der zentralen Universitätsverwaltung, Dekanat, externe Dienstleister) weitergeleitet.

2.5.2. Programmfortschritt

Um den Fortschritt Ihrer Bearbeitung zu überprüfen, kann Ihr/e länderspezifische/r Ansprechpartner*in (siehe § 2.4) Ihre Daten einsehen.

2.6. Löschung

Die personenbezogenen Daten werden aus dem System gelöscht, sobald sie nicht mehr für den Erhebungszweck benötigt werden.

Die Daten in Ihrem Nutzerprofil werden bis zur Löschung des Nutzerprofils gespeichert. Nutzerprofile werden zwei Jahre nach dem letzten Login oder bei Widerruf gelöscht.

Die Daten aus der Teilnahme des Kurses werden bis zur Löschung des Kurses gespeichert. Ergebnisse aus Tests, Lernpaketen und Aufgaben und Daten zum Abschluss des Kurses und der Gesamtbewertung werden maximal bis zum Ablauf gesetzlicher Aufbewahrungspflichten aufbewahrt.

Eine Löschungsprüfung erfolgt regelmäßig und zumindest jährlich.

2.7. Ihre Rechte

Sie haben bei Vorliegen der gesetzlichen Voraussetzungen verschiedene Ansprüche gegenüber der verantwortlichen Stelle im Hinblick auf die über Sie gespeicherten Daten. Zu Ihren Rechten gehören:

Auskunft (Art. 15 DSGVO): Sie haben gegenüber den Verantwortlichen (siehe § 5) das Recht, Auskunft über die Daten, die über Sie gespeichert werden, zu erhalten.

Recht auf Berichtigung (Art. 16 DSGVO): Sofern inkorrekte Daten gespeichert werden, können Sie diese z.T. selbst anpassen (selbst erfasste Profildaten) oder die Verantwortlichen auffordern, dies zu tun. Die Verantwortlichen werden der Aufforderung nachkommen, sofern die Berichtigung berechtigt und angemessen ist (Art. 16 DSGVO).

Recht auf Löschung (Art. 17 DSGVO): Sie haben einen Anspruch darauf, dass Daten gelöscht werden, die tatsächlich falsch sind oder für die die Verantwortlichen keinen weiteren Verwendungszweck haben. Ein Recht auf Löschung von Daten besteht nicht, wenn die Verantwortlichen verpflichtet sind, die Daten aus gesetzlichen Gründen oder durch andere Verpflichtungen noch vorzuhalten (Nachweis von Unterweisungen, Nachweis Qualitätssicherung, urheberrechtliche Nutzungsrechte, Prüfungsrecht). Die Pflicht zur Aufbewahrung von Daten kann auch nach Beendigung der Teilnahme am Kurs/des Beschäftigungsverhältnisses bestehen. Es besteht ebenfalls kein Anspruch auf Löschung, wenn Informationen von Ihnen selbst erfasst wurden und diese im Kontext mit Informationen anderer Nutzer stehen (z.B. Forenbeiträge).

Recht auf Einschränkung der Verarbeitung (Art. 18 DSGVO): Die Verantwortlichen werden sicherstellen, dass Daten im Falle der Einschränkung nur solchen Personen zugänglich sind, die die Daten unbedingt einsehen müssen. Dazu können sie sich der Mittel der Pseudonymisierung und der Anonymisierung bedienen.

Widerspruchsrecht (Art. 21 DSGVO): Sie können der weiteren Nutzung der Daten widersprechen. Dies ist nur für Daten, die danach erhoben werden, wirksam. Das Widerspruchsrecht ist keine automatische Verpflichtung zur Löschung der Daten für die Verantwortlichen. Sofern die Verantwortlichen Speicherpflichten aus anderen Gründen haben, werden diese dies abwägen und Sie informieren.

Datenübertragbarkeit (Art. 20 DSGVO): Sie haben einen Anspruch, Daten, die von Ihnen selbst erfasst wurden, in einem elektronischen Format zu erhalten, das für die Nutzung an anderer Stelle eingesetzt werden kann. Das Recht ist beschränkt auf Daten, die aufgrund einer Einwilligung oder aufgrund des Vertrages verarbeitet werden und die nicht einem Geschäftsgeheimnis oder anderer Verschwiegenheitspflichten unterliegen und daher nicht an andere Stellen übertragen werden dürfen oder die die Rechte anderer, z.B. Urheberrecht, betreffen.

Widerrufsrecht (Art. 7 DSGVO): Sie haben das Recht, eine Einwilligung zur Verarbeitung Ihrer Daten jederzeit zu widerrufen. Der Widerruf kann dazu führen, dass Sie danach keinen Zugang zur Lernplattform mehr erhalten und eine Teilnahme an einem Kurs nicht mehr möglich ist. Der Widerruf lässt die Rechtmäßigkeit der Datenverarbeitung bis zum Zeitpunkt des Widerrufs unberührt.

Im Falle eines Verstoßes gegen gesetzliche Bestimmungen zum Schutz der über Sie gespeicherten Daten können Sie eine Datenschutz-Aufsichtsbehörde ansprechen (Art. 77 DSGVO). Die für die LMU zuständige Aufsichtsbehörde finden Sie unter § 5. Bitte sprechen Sie zuerst die Verantwortlichen bzw. den behördlichen Datenschutzbeauftragten an (siehe § 5). In den meisten Fällen lassen sich dadurch Fragen klären und Beschwerden lösen.

Bei Löschung, Einschränkung oder Widerruf ist eine weitere Nutzung der Lernplattform sowie der Zugang zu den dort gespeicherten Lerninhalten sowie die Teilnahme an den dort vorhandenen Aktivitäten und Funktionen mit sofortiger Wirkung nicht mehr gewährleistet.

3. Verantwortlichkeiten des/der Nutzer*in und allgemeine Nutzungspflichten

Durch die Registrierung wird dem Nutzer bzw. der Nutzerin ein nicht übertragbares, einfaches Nutzungsrecht der Lernplattform übertragen.

Alle anderen Nutzungen der Lernplattform als die unter § 1 beschriebenen ‑ insbesondere private und/oder gewerblichen Nutzungen ‑ sowie die Nutzung für Marketingzwecke sind ausdrücklich untersagt. Allen Nutzer*innen der Lernplattform ist es untersagt, personenbezogene Daten unbefugt zu speichern, weiterzuverarbeiten, zu verändern, zu unterdrücken oder zu löschen. Dem Nutzer bzw. der Nutzerin zur Verfügung gestellter Speicherplatz darf ausschließlich zur Speicherung der erstellten Inhalte benutzt werden. Ebenso ist ein vom Zweck abweichender Gebrauch untersagt.

Darüber hinaus sind die Nutzenden verpflichtet, gesetzliche Bestimmungen im Allgemeinen sowie im Speziellen des Urheberrechtes und des Datenschutzes einzuhalten. Bei der Verlinkung auf externe Websites ist durch den Nutzer bzw. die Nutzerin zu prüfen, dass diese keine rechtswidrigen Inhalte aufweisen.

Nutzende dürfen gegen keine gesetzlichen Bestimmungen verstoßende, pornographische, obszöne, diffamierende, verleumderische, beleidigende, bedrohende, volksverhetzende oder rassistische Inhalte in die Lernplattform einstellen. Auch das Einstellen von Inhalten zum Zwecke der Werbung jeder Art, sowie die Übermittlung von Informationen, welche einen Virus, einen Fehler, Manipulationen oder ähnliche schädigende Elemente enthalten, ist untersagt, ebenso wie das Einstellen von Inhalten, die das Ansehen der LMU München oder des Klinikums der LMU München schädigen.

3.1. Besondere Pflichten im Umgang mit personenbezogenen Daten

Im Rahmen von Kursen haben Sie teilweise Zugriff auf personenbezogene Daten, z.B. die Namen und E-Mail-Adressen oder Foreneinträge von anderen Kursteilnehmer*innen. Alle Nutzer*innen sind verpflichtet, die ihnen zugänglichen Daten anderer Nutzer*innen, sowie personenbezogene Daten, zu denen sie Zugang erhalten, streng vertraulich zu behandeln und nicht unbefugt an Dritte weiterzugeben oder für andere Zwecke zu verarbeiten. Eine Ausnahme stellt ausschließlich die entsprechende schriftliche Einwilligung der oder des jeweils Betroffenen dar.

Besondere Kategorien von personenbezogenen Daten (z.B. Patientendaten/Gesundheitsdaten) dürfen nur nach den Vorgaben der DSGVO und sonstiger gesetzlicher Vorgaben mit ausdrücklicher schriftlicher und wirksamer Einwilligung der oder des Betroffenen zweckgebunden ins System eingestellt werden. Grundsätzlich sind derartige Daten nur in pseudonymisierter, möglichst aber in anonymisierter Form zu verarbeiten.

3.2. Urheberrecht

Die auf dieser Webseite veröffentlichten Inhalte, Werke und bereitgestellten Informationen unterliegen dem deutschen Urheberrecht und Leistungsschutzrecht. Jede Art der Vervielfältigung, Bearbeitung, Verbreitung, Einspeicherung und jede Art der Verwertung außerhalb der Grenzen des Urheberrechts bedarf der vorherigen schriftlichen Zustimmung des jeweiligen Rechteinhabers. Das unerlaubte Kopieren/Speichern der bereitgestellten Informationen auf diesen Webseiten/Lernplattformen ist nicht gestattet und strafbar.

Die Betreiber der Seiten sind bemüht, stets die Urheberrechte anderer zu beachten bzw. auf selbst erstellte sowie lizenzfreie Arbeit zurückzugreifen.

Alle auf Internetseiten abgebildeten Marken, Logos, Warenzeichen und Produktnamen unterliegen den Schutzrechten der Betreiber und dürfen nicht ohne Erlaubnis verwendet werden. Mit der Präsentation dieser Marken auf der Website werden keine Rechte zur Nutzung eingeräumt und impliziert nicht, dass diese Marken und Logos nicht durch Rechte Dritter geschützt sind.

4. Weitere Regelungen

4.1. Haftung auf Seiten der Nutzer/-innen

Verstößt ein/-e Nutzer*in schuldhaft gegen die Nutzungsbedingungen oder gegen gesetzliche Pflichten, so haftet er/sie den gesetzlichen Vorgaben entsprechend.

4.2. Nutzungsausschluss

Besteht ein Verstoß gegen die Nutzungsbedingungen, so wird der Nutzer bzw. die Nutzerin aufgefordert, dieses Verhalten zu unterlassen. Kommt er bzw. sie dieser Aufforderung nicht nach, so wird er bzw. sie von den Administratoren*innen der Lernplattform von der Nutzung ausgeschlossen. Ein Anspruch auf eine Wiederzulassung besteht nicht. Voraussetzung für eine Wiederzulassung ist u.a. ein schriftlicher Antrag mit der Versicherung, dass das missbräuchliche Verhalten in Zukunft unterlassen wird.

4.3. Haftung auf Seiten der LMU München/Klinikum LMU

Die LMU München/Klinikum München, als Betreiberin der Lernplattform, haftet ausschließlich für grob fahrlässige bzw. vorsätzlich begangene Pflichtverletzungen. Das gilt insbesondere auch für solche Schäden, die durch das Herunterladen von Software oder Materialien von Nutzenden entstehen. Die LMU München/Klinikum LMU ist von Ansprüchen Dritter aus der Nichtbeachtung von Urheberrechten durch die Nutzenden der Lernplattform freizustellen.

4.4. Änderung der Nutzungsbedingungen

Die LMU München/Klinikum LMU behält sich vor, diese Nutzungsbedingungen zu erweitern oder zu ändern. Über Änderungen an den Nutzungsbedingungen werden Nutzer*innen der Lernplattform fortlaufend informiert. Die jeweils gültigen Nutzungsbedingungen werden auf der Lernplattform veröffentlicht.

4.5. Rechtswirksamkeit

Diese Ausführungen sind als Teil des Internetangebotes zu betrachten, von dem aus auf diese Seite verwiesen wurde. Sofern Teile oder einzelne Formulierungen dieses Textes der geltenden Rechtslage nicht, nicht mehr oder nicht vollständig entsprechen, bleiben die übrigen Teile des Dokumentes in ihrem Inhalt und ihrer Gültigkeit davon unberührt.

8. Nutzung des Webseiten-Analyse-Tools Matomo (ehemals PIWIK)

Programme zur Auswertung des Nutzerverhaltens auf den LMU/KUM-Internetseiten werden von der LMU/KUM nur in anonymisierter Form eingesetzt. Auf einigen Internet- und Moodle-Seiten setzen wir das Open-Source-Software-Tool Matomo (ehemals PIWIK) zur Analyse Ihres Surfverhaltens ein. Diese Software setzt einen Cookie auf Ihrem Computer. Werden einzelne Seiten - auch Unterseiten - unserer Internetseiten aufgerufen, so werden die folgenden anonymisierten Daten gespeichert.

• Zwei Bytes der IP-Adresse des aufrufenden Systems (System des Nutzers)
• Die aufgerufene Internetseite
• die Internetseite, von der aus der Nutzer bzw. die Nutzerin auf die aufgerufene Internetseite gelangt ist (Referrer)
• die Unterseiten, die von der aufgerufenen Internetseite aufgerufen werden
• Die Verweildauer auf der Internetseite
• die Häufigkeit des Aufrufs der Internetseite
• Informationen über das Betriebssystem, den Browsertyp, die Auflösung des Bildschirms

Die Software Matomo ist so eingestellt, dass nicht die vollständige IP-Adresse gespeichert wird, sondern zwei Bytes der IP-Adresse maskiert werden. Dadurch ist eine eindeutige Zuordnung zum aufrufenden Rechner nicht möglich. Daher wird auch Ihre IP-Adresse vor jeder Auswertung immer anonymisiert.

Die Software läuft ausschließlich auf den Servern der LMU/KUM. Eine Speicherung der Daten erfolgt nur auf diesen Servern. Eine Weitergabe an Dritte findet nicht statt. Weitere Informationen zu Matomo finden Sie unter https://matomo.org/docs/privacy[FF1]/(externer Link).

Die Nutzung von Matomo kann durch eine entsprechende Einstellung in Ihrem Internetbrowser generell deaktiviert werden.
